Acceptable Use Policy

1. Purpose
This Acceptable Use Policy (“AUP”) defines the rules for using the HomeStation phone service (“Service”) provided by ClearBeam Networks, LLC (“ClearBeam”). This AUP is incorporated into and forms part of our Terms of Service. By using the Service, you agree to comply with this AUP.
2. Prohibited Activities
You may not use the Service to:
2a. Robocalling and Auto-Dialing
- Make automated or pre-recorded voice calls (robocalls) without the prior express consent of the called party, as required by the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227).
- Use automatic telephone dialing systems (ATDS) or predictive dialers to place calls through the Service.
- Transmit unsolicited telemarketing calls or text messages.
2b. Spam and Fraud
- Engage in caller ID spoofing with intent to defraud, cause harm, or wrongfully obtain anything of value, in violation of the Truth in Caller ID Act (47 U.S.C. § 227(e)).
- Impersonate any person, business, or government agency.
- Conduct phone phishing (“vishing”) or social engineering attacks.
- Use the Service in connection with any scheme to defraud.
2c. Harassment and Abuse
- Make threatening, harassing, or abusive calls.
- Make repeated calls with intent to annoy, abuse, or harass.
- Use the Service to stalk or intimidate others.
2d. Network Abuse
- Generate artificially inflated call traffic or traffic pumping schemes.
- Resell, redistribute, or share the Service with third parties without written authorization from ClearBeam.
- Attempt to gain unauthorized access to ClearBeam’s network, systems, or other customer accounts.
- Interfere with or disrupt the Service or networks connected to it.
- Use the Service for any illegal purpose under federal, state, or local law.
2e. Commercial Use Restrictions
- The HomeStation service is designed for residential use. Using the Service as a call center, for commercial telemarketing, or for high-volume commercial calling is prohibited without a separate commercial agreement.
3. Fair Use
While plans include “unlimited” calling, the Service is intended for normal residential voice communication. ClearBeam reserves the right to review accounts with usage patterns that significantly exceed normal residential use (for example, sustained calling exceeding 5,000 minutes per month or patterns consistent with commercial use). If we determine that usage is excessive or inconsistent with residential use, we may contact you to discuss appropriate plan options.
4. STIR/SHAKEN Compliance
ClearBeam implements STIR/SHAKEN caller ID authentication as required by federal law. All outbound calls from the Service are authenticated and signed. We cooperate with industry traceback efforts to combat illegal robocalling.
5. Do Not Call Compliance
If you use the Service for any permissible telemarketing (e.g., calls to existing customers with express consent), you are solely responsible for compliance with the National Do Not Call Registry and all applicable federal and state telemarketing laws and regulations.
6. Monitoring and Enforcement
ClearBeam monitors call patterns and network usage to detect violations of this AUP. We do not monitor the content of your calls. If we reasonably determine that you have violated this AUP, we may:
- Issue a warning and request that you cease the prohibited activity.
- Temporarily suspend your Service.
- Permanently terminate your Service without refund.
- Report the activity to appropriate law enforcement or regulatory agencies.
For severe or repeated violations, we may terminate service immediately without prior warning.
7. Reporting Violations
If you believe someone is using the Service in violation of this AUP, please report it to support@myclearbeam.net.
8. Changes
ClearBeam may update this AUP from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
